3. Ordering and Acceptance
Orders are placed via our website, in our store, via email or phone.
All orders are subject to acceptance and availability. Toolbike AG reserves the right to refuse any order.
By placing an order, you confirm that you are at least 18 years of age or have the consent of a parent or guardian.
4. Pricing and Payment
All prices are listed in Swiss Francs (CHF), Euros (€) and US Dollars ($). For convenience, international customers from countries with currencies other than those listed may see converted prices based on the primary currency Swiss Francs (CHF).
Prices are subject to change without prior notice.
Prices do not include local taxes, customs duties, or shipping fees, unless otherwise stated or if not explicitly listed.
The following payment methods are available in our online shop:
Credit Card (Visa, Master and Maestro)
With the submission of the order, you are sending us your credit card details at the same time.
After your identification as the legal cardholder, directly after the contract conclusion, we will ask your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company and charged to your card.
We reserve the right to adjust pricing at any time, but any change will not affect orders that have already been placed and confirmed.
5. Availability, Shipping and Delivery
Availability: All products are subject to availability. We endeavor to keep our stock up to date, however there may be times when a particular item is not in stock.

You are entitled to collect your order from Toolbike AG, Zollstrasse 117 , 8005 Zürich, Switzerland during our opening hours.
We do not deliver to packing stations.
Shipping Costs: Shipping costs are calculated during checkout and vary depending on your location and the size/weight of the product.
Delivery Times: Estimated delivery times depend on the availability of the components in your order and your shipping address. Please inquire before placing an order. In any case, delivery times are not guaranteed due to factors beyond our control, such as customs delays.
Duties and Taxes: For international orders, customers are responsible for paying any applicable import duties, taxes, or customs fees, and associated handling charges, which are not included in the product price or shipping fees.
6. Damage during delivery and returns
Damage during delivery: If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

If you are a consumer residing in the European Union, you have the right to withdraw from this contract within 14 days of receiving the goods without giving any reason. To exercise your right of withdrawal, you must inform us (Toolbike AG, Zollstrasse 117, 8005 Zürich, Switzerland) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, or email). To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.
In the event of a withdrawal from the purchase contract, Toolbike AG must be notified in order to arrange the return. Additional shipping costs will apply, which are the full responsibility of the customer and will be deducted from the refund. Furthermore, the original shipping costs will also be deducted from the reimbursed amount. Please note that since we do not charge the full shipping fees incurred with our shipping partner, the deducted amount for the original shipping costs may be up to double the initial shipping fees.
7. Warranty
We offer a 5-year warranty on components manufactured by Toolbike AG (frame, fork, steerer and cargo racks). This warranty covers manufacturing defects only and does not cover normal wear and tear, misuse, or damage caused by accidents.
Other warranty periods vary by product. Please refer to the product documentation or consult us for specific warranty details.
8. Limitation of Liability
Toolbike AG is not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
In no event shall our liability exceed the amount paid by the customer for the purchased product.
We are not responsible for delays or failures caused by events beyond our control, such as customs delays or force majeure events (natural disasters, pandemics, etc.).
9. Intellectual Property
All content, including logos, images, and text on MONoPOLE's website, is the intellectual property of MONoPOLE and may not be used or reproduced without prior written consent.

11. Governing Law
For Customers in Switzerland: These General Terms and Conditions (GTC) and the contracts based on them are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Zurich.
For All Other Customers: Swiss law governs all contracts. The place of jurisdiction is Zurich. However, this only applies to you as a consumer to the extent that it does not deprive you of the protection afforded by the mandatory provisions of the law of the state in which you are habitually resident. The CISG is expressly excluded.
Should any provision of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provisions will be replaced by valid provisions that closely approximate the intent of the original provisions.

Toolbike AG reserves the right to modify these Terms and Conditions at any time. Any changes will be effective upon posting on our website. Your continued use of the website following any changes indicates your acceptance of the new terms.
